Indonesia had enacted Trademark Law since 1961. However, judicial practice is less than satisfactory. There are 15 well-known trademark cases decided by the Supreme Court in the past 3 years where the decisions have caused legal uncertainty in the interpretation and application of the relevant provisions of Trademark Law and cast doubt on the legal protection of the worthy owners of well-known trademarks. The session will explore the solutions to effectively protect well-known trademarks.
