Prof Lucy will explore the “softer” aspects of arbitrator decision-making, as relevant to counsel decision-making on case strategy. Research on the process of decision-making in arbitration (involves the balance between intuition and deduction, and the positive and negative impact on decision-making of “heuristics” and resulting cognitive biases), and how counsel can use this research in strategizing how to present their clients’ cases more effectively in arbitration will be covered.
