Today's law of money developed in the era of the gold standard, and has barely changed since. It is therefore not well equipped to address the challenges resulting from the creation of money-like private tokens. Regardless of whether these tokens are successful in replacing state-created money, their existence raises real questions of legal theory which deserve to be addressed, and by doing so we can develop our understanding of the laws of money, payments and finance.
