In the last decade, there has been a noticeable shift in both decided cases and academic commentary, with the focus increasingly on the interpretation and efficacy of particular contractual provisions. This seminar outlines the applicable principles and policies for contractual interpretation and addresses two important aspects of standard contractual provision, i.e. the requirement for parties to engage in ADR and the restriction of variation or wavier clauses.
