Event Outline

Reflective loss provides a lens for comparative analysis of how and why countries uphold the doctrine of separate legal personality. In many countries a shareholder cannot file a direct claim for damages for reflective loss (the prohibition principle). This lecture reexamines the rationales for the prohibition principle in light of more flexible interpretations of corporate personality and argues for relaxation of the prohibition principle to facilitate fair and efficient shareholder protection.
