Unregistered and unregistrable intellectual property (IP) rights and related intangible assets play a vital role in shaping commercial success. Examples include trade names, copyrighted material, proprietary algorithms, and confidential information. In practice, issues such as ownership, use, enforcement, and valuation can be slippery and hard to navigate. To complicate matters, different legal systems may treat these rights – if they may be called that – very differently.
