The subject of a doctor’s duty of care to his patient is a controversial one. In recent times, the courts and the medical professions in several jurisdictions have given varying responses. In Hii Chii Kok v Ooi Peng Jin [2017] SGCA 38, Singapore’s apex court was faced with the difficult challenge of whether to and, if so, how to change the law, especially having regard to the UKSC decision in Montgomery. This seminar examines SCA decision and its implications.
