Anti-suit injunctions in transnational disputes (and maritime disputes are no different) have always been controversial, because they (indirectly or directly) impinge upon the powers of the relevant foreign court to exercise its own sovereign jurisdiction. This address will explore some of the chief complexities and controversies in relation to anti-suit injunctions; focusing on the award of damages for breach of forum or arbitration agreements, as a substitute for or supplement to anti-suit injunctions.
