Arbitral Tribunals are expected to arrive at principled decisions on questions of substance and procedure, based on the application of relevant legal principles. They are often confronted with the need to first identify the applicable law. This can create conflicts of law issues which are particularly challenging in where there are cross-border elements of the sort routinely encountered in International Arbitration, particularly in the absence of an express choice of law by the parties
