Consent is said to be the foundation of international arbitration. Is this postulate correct, or is it partially an overstatement? The analysis of the jurisprudence raises the question of whether the courts’ approach in some jurisdictions is still truly based on consent and, more fundamentally, what approach should be preferred, taking into consideration the parties’ expectations and the realities of the business community in the 21st century.
