This session is to cover (1) what it takes to win creditor support before pre-pack filing, referencing practices in the US, the Netherlands and SG; (2) how the lack of shareholder cramdown in SG has or may have posed challenges in pre-packs there, and would it affect the recognition in SG of US pre-packs that entail equity cancellation; (3) would the lack of cross-class cramdown in a SG pre-pack force a debtor’s hand; (4) what does the SG Bench want to see in pre-packs presented before them.
