Arbitrators are obliged decide a dispute in accordance with the rules of law chosen by the parties or as determined according to conflict of law rules. Yet, there is no corresponding basis under Singapore law (& in most jurisdictions) that would permit parties to meaningfully enforce this obligation. Does this incongruence create a moral hazard in which tribunals may determine questions of law in accordance with their own sense of justice? If so, what, if anything, should be done about it?
