“Rethinking The Theoretical Framework of Arbitration”: The dominant view is that arbitration agreements are just like any other contracts, and are based on consent. However, when arbitration agreements enter into the public sphere of judicial intervention to have their terms enforced, they are very different from other contracts. The lecture will focus on this neglected perspective, the light it sheds on arbitration law, the principles that underlie it, and the rules that constitute it.
