How have apex courts responded to shrinking policy space due to international treaties that protect foreign investors’ contract/property/due process rights? The lecture catalogues how apex courts have responded to these challenges both in the Global North/selected Global South courts & concludes with a normative argument about why courts are duty bound to closely scrutinize treaties for their constitutional compatibility, rather than yielding to the exigencies of international economic law.
