Multi-tiered dispute resolution clauses often require parties to engage in a series of alternative dispute resolution methods—such as negotiation, mediation, expert determination, adjudication, and/or dispute boards—before advancing to arbitration. However, the layering of such processes introduces complexity in drafting and interpretation, frequently resulting in disputes over the enforceability of the clauses themselves. Hence, delaying the finality of disputes and add procedural hurdles.
