Constructive trusts occupy a unique position in common law and is one of equity’s strongest tools in resolving property disputes, yet their incremental development in case law has led to doctrinal uncertainty. This lecture, drawing on Singapore, England and Australia, addresses the roles/rationales of constructive trusts, how rights, remedies and judicial discretion interact and the complex choice of law issues they create in cross-border disputes, and analytical frameworks to restore coherence.
